Beschlussvorschlag
Der Ausschuss für Stadtentwicklung beschließt gemäß § 6 Straßen- und Wegegesetz des Landes Nordrhein-Westfalen (StrWG NRW) folgende Gemeindestraßen als Hauptverkehrs-, Haupterschließungs-, Hauptgeschäfts- und Anliegerstraßen sowie Plätze dem öffentlichen Verkehr zu widmen:
Albrecht-Dürer-Straße - Anliegerstraße
Alte Luisenstraße - Hauptgeschäftsstraße
An der Ziegelei - Anliegerstraße
Bahnhofsplatz - Anliegerstraße
Grenzweg - Haupterschließungsstraße
Luisenstraße - Hauptverkehrsstraße
Martin-Luther-Straße - Anliegerstraße
Otto-Brenner-Straße - Anliegerstraße
Rebenstraße - Anliegerstraße
Saint-Brieuc-Platz - Platz
Weinstraße - Hauptverkehrsstraße
Würselener Straße - Hauptverkehrsstraße
Zollernstraße - Anliegerstraße
Sachverhalt
Darstellung der Sachlage:
Für die im Beschluss aufgeführten Straßen (vgl. Karten in Anlage 1 Seite 1 bis 8 sowie Anlage 2 Seite 1 bis 7) liegen nur teilweise rechtsverbindliche Widmungsverfügungen vor. Aus Gründen der Rechtssicherheit ist eine förmliche Widmung vorzunehmen, auch wenn die Straßen schon lange bestehen.

Darstellung der Rechtslage:
Gemäß § 6 Abs. 1 des Straßen- und Wegegesetzes für das Land Nordrhein-Westfalen (StrWG NRW) ist die Widmung die Allgemeinverfügung, durch die Straßen, Wege und Plätze die Eigenschaft einer öffentlichen Straße erhalten. Die Widmung verfügt die Straßenbaubehörde (§ 6 Abs. 2 StrWG NRW).
Die Straßenbaubehörde ist bei allen aufgeführten Straßen entsprechend § 3 Abs. 4 StrWG NRW die Stadt Alsdorf.
